1. Acceptance

These Terms govern your access to and use of the Preswipe mobile application and related services (the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy.

2. Eligibility

You must be 18 years or older to use Preswipe. The Service allows SFW (safe-for-work) photos only.

3. Accounts

You are responsible for your account and for keeping your login secure. We may suspend or terminate accounts that violate these Terms or applicable law.

4. Your Content & License

You retain ownership of photos and other content you upload ("User Content"). You grant Tulpa, Inc. a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and distribute User Content within the Service for the purpose of operating, improving, and moderating Preswipe.

We will not use your photos in external marketing without your separate, explicit consent.

You represent that you have all rights necessary to upload the content (including consent from anyone depicted).

5. Community & Acceptable Use

You agree not to:

• upload nudity, pornographic, violent, hateful, harassing, illegal, or infringing content;
• impersonate others, dox, or engage in abuse;
• attempt to bypass security, reverse engineer, scrape, or misuse the Service;
• use the Service in violation of any law or third-party rights.

We may remove content or restrict access at our discretion to protect users and the Service.

6. Virtual Items, Purchases, and Subscriptions

Preswipe may offer in-app credits or similar virtual items. Credits have no cash value, are non-transferable, and are non-refundable except where required by law.

Purchases and subscriptions are processed by the Apple App Store/Google Play and managed by RevenueCat. Auto-renewing subscriptions bill until canceled in your store account settings. Pricing and features may change; see the in-app offer for terms. Refunds are handled by the respective app store.

7. Moderation & Safety

We may monitor and review content to enforce SFW standards and these Terms, and we may remove content or suspend accounts where appropriate.

8. Intellectual Property

The Service, including trademarks, logos, code, and design, is owned by Tulpa, Inc. or its licensors and is protected by law. Except as expressly allowed, you may not copy, modify, distribute, or create derivative works of the Service.

9. Third-Party Services

The Service integrates third-party services (e.g., Apple/Google stores, Firebase, RevenueCat, Expo push). Their terms and privacy practices apply in addition to ours.

10. Copyright/DMCA

If you believe content infringes your rights, email [email protected] with: (a) your contact details; (b) the work claimed infringed; (c) the content URL/description; and (d) a statement under penalty of perjury that you are authorized and the notice is accurate. We may remove content and, where appropriate, terminate repeat infringers.

11. Termination & Account Deletion

You may stop using the Service at any time. You can initiate account deletion from within the app (e.g., Settings → Delete Account). Once confirmed, we will permanently delete or anonymize your personal data within 30 days, subject to limited retention where required by law or for fraud prevention, security, or record-keeping (see our Privacy Policy). We may suspend or terminate access for violations of these Terms.

12. Disclaimers

The Service is provided "as is" and "as available." To the maximum extent permitted by law, Tulpa, Inc. disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, and does not guarantee availability or particular outcomes.

13. Limitation of Liability

To the maximum extent permitted by law, Tulpa, Inc. and its affiliates will not be liable for indirect, incidental, consequential, special, or punitive damages, or for lost profits, data, or goodwill. Our total liability for any claim relating to the Service is limited to the greater of US $50 or the amounts you paid to us for the Service in the six (6) months before the claim.

14. Indemnity

You agree to indemnify and hold Tulpa, Inc. harmless from claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your User Content, your use of the Service, or your breach of these Terms or applicable law.

15. Changes to the Service and Terms

We may modify or discontinue features at any time. We may update these Terms from time to time. If changes are material, we will provide reasonable notice (e.g., in-app or by email). Your continued use after the effective date constitutes acceptance.

16. Governing Law & Venue

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-laws rules. You agree to the exclusive jurisdiction and venue of the state and federal courts located in Delaware for disputes not otherwise subject to mandatory consumer law.

17. Miscellaneous

If any provision is found unenforceable, it will be limited or severed to the minimum extent necessary, and the remainder remains in effect. You may not assign these Terms without our consent. These Terms, together with the Privacy Policy, are the entire agreement between you and Tulpa, Inc. regarding the Service.
